Welcome to AI3DGen.com (the 'Service'). The Service is operated by AI3DGen.com. By accessing, browsing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these Terms, you may not use the Service.

2. Description of Service

AI3DGen.com provides an AI-powered 3D model generation platform that allows users to convert 2D images (such as JPG, PNG, and WebP files) or text descriptions into 3D model files (e.g., .GLB, .OBJ, and .STL). The Service includes a free Base version and paid Pro and Ultra versions.

3. User Eligibility and Accounts (For Paid Services)

The following stipulations govern user eligibility and account usage:

• Eligibility: Users of the Service must be of legal age, or use the Service with the consent of a parent or guardian.
• Accounts: While the free version does not require sign-up, access to premium features like Pro/Ultra may require account creation. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. User Conduct and Content Uploads

4.1. Intellectual Property and Usage Rights

• Your Input Content: You represent and warrant that you own all necessary rights, licenses, and permissions for the 2D images and data you upload to the Service, or have the authorization to use, reproduce, and convert such content.
• Rights to Generated Models: Subject to your compliance with these Terms, you retain ownership and/or commercial usage rights over the 3D models you generate using the Service ("Generated Content").

4.2. Prohibited Content and Conduct

You agree not to upload, generate, or use the Service to process any content or engage in any conduct that:

• Illegal Activities: Violates any local, state, national, or international laws or regulations.
• Infringement: Infringes upon any third party’s intellectual property rights (including copyright, trademark, and patent), privacy rights, or publicity rights.
• Harmful/Offensive Content: Is defamatory, harassing, obscene, pornographic, violent, hateful, or discriminatory.
• Service Abuse: Interferes with or disrupts the Service, its servers, or networks; or uses the free service in a manner intended to bypass limits or quotas.
• Security: Contains viruses, malware, or other code intended to harm the Service.

5. Intellectual Property and Proprietary Rights

5.1. Ownership of Service

The Service (including all software, AI models, algorithms, designs, text, graphics, trademarks, and technology) is the proprietary property of AI3DGen.com and its licensors, protected by copyright, trademark, and other intellectual property laws.

5.2. Training Data Privacy

As stated on the website, your uploaded images and generated models will be kept confidential and will never be publicly shared or used for training the AI models without your explicit permission.

6. Free Service and Paid Subscriptions

• Free Service (Base): The Service offers a free tier (Base) that users can access without sign-up, but its functionality, export formats, processing speed, and model detail (e.g., face count) may be limited.
• Paid Services (Pro/Ultra): Paid subscriptions provide enhanced features, high-fidelity textures, faster processing, and full-format exports. Subscription details and fees are outlined on the Pricing page.

6.1. Refund and Cancellation Policy

AI3DGen.com promotes a 'trial-first' approach, providing a free (Base) version for you to evaluate the platform's core capabilities and output quality before making any purchase. Consequently, all purchases of subscriptions or credits are non-refundable, except where mandatory under applicable law or at our sole discretion.

1. Discretionary Refund Criteria

Refund applications must be submitted within five (5) days of the transaction date. A user is eligible for a discretionary refund only if they furnish conclusive evidence that even the highest-tier Ultra model failed to produce a viable 3D model from the input. This evidence must include:

• The original 2D input image submitted for conversion.
• The resulting 3D model (or verifiable screenshot) generated specifically by the Ultra model.

2. Processing Refunds

• Review Process: Our review team will assess the submitted request and evidence within 3–5 business days.
• Used Credits: Any credits already utilized are excluded from refund calculation. Approved refunds will be partial, reflecting only the monetary value of the unused credits. We reserve the right to decline refunds if credit usage is significant (e.g., exceeding 80%).
• Disbursement: Approved amounts will be returned to the original payment method. Please allow up to 2-3 business days after approval for the funds to reflect in your account.

3. Technical Faults

In cases where credits are proven to have been lost or incorrectly debited due to a technical error verified on our platform, the compensation will be in the form of replacement credits. A verified technical fault does not automatically qualify the user for a monetary refund.

4. Subscription Termination

Users can cancel their subscription at any point. The cancellation becomes effective at the conclusion of the active billing cycle, preventing any future recurring charges. Access to the subscribed services continues until the cycle ends.

5. Submitting a Request

All refund requests must be sent via email to [email protected], providing your registered account email, order details, the mandatory evidence outlined in Section 1, and a comprehensive explanation.

7. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. AI3DGen.com makes no warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

• Model Quality: While we use advanced AI technology, we do not guarantee that the generated 3D models will always meet your specific expectations, be perfectly accurate, or be suitable for all professional uses. You understand and accept that the nature of AI conversion may lead to imperfect results.
• Interruption: We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, AI3DGen.com shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of the use or inability to use the Service, even if we have been advised of the possibility of such damages.

9. Termination and Data Deletion

AI3DGen.com reserves the right to terminate or suspend your access to all or part of the Service at any time, for any reason (including, but not limited to, a breach of these Terms), without prior notice or liability. Upon termination, we will delete any uploaded images and generated models within 30 days, except as required by law.
